The newly revised "Marriage Registration Regulations" will be implemented from May 10. The new regulations such as marriage registration being "national" and marriage registration no longer require a household registration book to provide convenience for the public to handle marriage registration. In order to further standardize marriage registration work, the Ministry of Civil Affairs recently issued the "Marriage Registration Work Standards" and responded to issues of concern to society.

What is the specific scope of acceptance for the "national handling" of marriage registration?

Marriage registration, divorce registration and re-acquisition of marriage registration documents for both parties are mainland residents. Marriage registration, divorce registration and marriage registration certificate for one party is a mainland resident, and the other party is a foreigner, Hong Kong, Macao and Taiwan resident or overseas Chinese. It can be handled in any marriage registration authority with relevant marriage registration authority.

What other materials do the parties need to prepare in advance?

After the marriage registration is "national" and mainland residents apply for marriage registration, both men and women only need to issue their own resident ID cards, they have no spouse and have no direct blood relatives with the other party and have a collateral blood relative within three generations, and they no longer need to issue a household registration book. For the parties involved, the documents and supporting documents that need to be issued have been streamlined, making it more convenient to register a marriage. On the basis of complete documents, accurate materials and consistent verification, the marriage registration authority will handle marriage registration for both parties.

In order to ensure that the parties successfully register their marriage, what else should be paid special attention to?

If the marital status and identity information declared by the parties are inconsistent with the verification information of the marriage registration authority, proof materials shall be provided to the marriage registration authority. If the marital status is declared as "divorce", the court shall provide the effective judicial documents, divorce certificates or divorce certificates issued by the court; if the marital status is declared as "widowed", the deceased spouse's medical certificate of death (inference) and marriage certificates shall be provided; if the identity information is inconsistent with the verification information, the corresponding materials shall be provided to prove it.

According to Article 23 of the Marriage Registration Regulations, the parties shall be responsible for the authenticity and legality of the issued documents and materials. If they issue false documents or materials, they shall bear corresponding legal responsibilities. The relevant information shall be recorded in the credit record in accordance with relevant national regulations and included in the national credit information sharing platform.

If one party who registers a marriage is a mainland resident, and the other party is a foreigner, Hong Kong, Macao and Taiwan resident or overseas Chinese, can it also apply for the "national operation"?

The party’s marriage certificate is lost and needs to get a marriage certificate. Is the specific method the same as before?

The ways in which marriage registration files are provided have changed. When applying for a replacement marriage certificate, you must provide your resident ID card and a paper marriage registration file with a special seal stamped for checking the marriage certificate.

If the party has not obtained paper files and the marriage registration authority can obtain the parties' electronic marriage registration files through different locations, the marriage registration authority can provide remote file retrieval services after application;

If the file information cannot be obtained through sharing, it is recommended to consult the original agency that handles marriage registration or the department that keeps marriage registration files, and then re-get the certificate after obtaining the proof of marriage registration files.

The parties involved were originally mainland residents and registered for marriage in the mainland. Now they live in Hong Kong and their identities have also changed. Where should I get my marriage certificate in this case?

If one party changes from a mainland resident to a foreigner, a resident of Hong Kong, Macao and Taiwan, or an overseas Chinese, both parties may apply for reimbursement from any marriage registration authority with the authority to handle relevant marriage registration;

If one party becomes a foreigner, the other party becomes a resident of Hong Kong, Macao and Taiwan, or both parties become a resident of Hong Kong, Macao and Taiwan or an overseas Chinese, they need to apply for reimbursement from the original marriage registration authority, an agency with relevant marriage registration authority where they work or live;

If both parties become foreigners, they can obtain the marriage registration file, but they cannot obtain the marriage certificate.

It should be noted that in addition to providing regular materials for reissue marriage registration certificates, parties with changes in their identities must also provide proof or notarization statements that the previous and subsequent identities are the same person.
